Thomas Pyke formerly Crouch In the Name of God Amen I Thomas Pyke (heretofore named Thomas Crouch) of Redlyon Street otherwise Lambs Conduit Street Holborn in the Parish of Saint George the Martyr in the County of Middlesex Esquire being of sound and disposing mind memory and understanding Do make publish and declare this to be my last will and Testament in manner and form following that is to say

ffirst I desire my Executors hereinafter named to bury me in a decent manner near the remains of my late ffather and mother in the parish church of Layston near Buntingford in Hertfordshire and that an addition be made to the Inscription on the monument lately erected there to their Memory to the effect following Viz “ who died the day of …. aged … years” and nothing more

Whereas am seized to me and my heirs according to the custom of the Manor of Birdbrook in the county of Essex of and in certain Copyhold Lands Tenements and hereditaments called Tylers lying within and held of the said Manor by copy of Court Roll (all which I have surrendered to the use of my will) and which said Lands Tenements and hereditaments were heretofore part of the Estate of my late uncle John Pike deceased which in and by his last will and Testament were devised to me for my life with divers remainders over

Now I do hereby give and devise all and singular the said Copyhold Lands Tenements and hereditaments called Tylers unto the person or persons who immediately upon my decease shall by virtue of and according to the devises and limitations thereof expressed and contained in my said late uncle’s said will be intitled to his ffreehold Estate and premises of which I am now seized for the term of my life under his said will with divers Remainders over as aforesaid and to the heirs and assigns of such person or persons for ever It being my intent and meaning that the said copyhold Lands Tenements and hereditaments called Tylers and the said ffreehold and Copyhold Lands Tenements and hereditaments of my said late uncle shall after my decease go and be held and enjoyed together as one Estate under and subject to the devises and limitations thereof expressed and declared in my said uncles said will so far as the same shall be then subsisting or capable of taking effect and as to all and singular other my Real or ffreehold and Copyhold Estates of what nature or kind soever or wheresoever the same may be situate standing or being as well those in possession or those in Reversion Remainder or Expectancy which I shall be seized or possessed of interested in or intitled unto at the time of my decease (except the aforesaid Copyhold premises called Tylers) and also all and singular my Monies in the public Stocks and ffunds upon Government or other securities whatsoever and all other my personal estate of what nature or kind soever which I shall or may be possessed of interested in or intitled unto in any manner howsoever at the time of my decease I hereby give and devise and bequeath unto

and Charles Wade of New North Street by Red Lyon Square Esquire

and to their heirs Executors Administrators and assigns for ever Upon the several uses and Trusts and to and for the several ends Intents and purposes and under and subject to the several Bequests and directions hereinafter mentioned expressed and declared of and concerning the same respectively that is to say

ffirst I do order and direct my said Trustees as soon after my decease as the possibly can to sell and dispose of all and singular my said Real or ffreehold and Copyhold Estates (except the said premises called Tylers) for the best price or prices that can be procured or gotten for the same and that by and out of the monies to arise by such sale or sales they deduct and retain to themselves all such costs charges and expenses which they or any or either of them may be at in the sale and disposition of my said Estates

I do hereby give and bequeath unto James Walford of Sturmer in the County of Essex one of the sons of James Walford late of Wheatley in Essex deceased the sum of six thousand pounds £6000 to be paid him by my Executors hereinafter named But in case the said James Walford shall dye in my lifetime or before he becomes intitled to the said legacy Then I do hereby direct my Executors hereinafter named as soon after my decease as they can to transfer into their Names or into the names or name of the survivors or Survivor of them the sum of £3400 part of my Bank Annuities reduced to 3 per cent now standing in my name in the books of the Governor and Company of the Bank of England or to the like Value in any other of the public Stocks or ffunds so that the annual clear interest or dividends thereof do not fall short of the sum of one hundred pounds and I do direct my said Executors to pay and apply such interest or dividends as and when the same shall become due and payable unto the Widow of the said James Walford for and during the term of her natural life and I do declare that her receipts alone shall from time to time be sufficient discharges to my said Executors for the same And from and immediately after her decease I do direct that the said sum of three thousand four hundred pounds Bank annuities reduced shall sink into the Residuum of my Estate and Effects and be had taken and Considered as part thereof I hereby also give and bequeath unto the present wife of the said James Walford (if she shall be living at the time of my decease) the sum of One hundred pounds to be paid to her for her own use and benefit whose receipt alone notwithstanding her Coverture I do declare shall be a sufficient discharge to my Executors for the same

I do hereby give and bequeath unto such of the children of Ann Swan deceased the late wife of Owen Swan and one of the Sisters of the said James Walford as Shall be living at the time of my decease the sum of one Thousand pounds to be equally divided between them share And share alike at their respective ages of twenty one year with Benefit of survivorship in case any of them should dye before they attain that age and I do direct my Executors to invest the said One Thousand pounds in Government Securities in their names and make distribution thereof with the accumulating interest thereon unto the said children of the said Ann Swan as they respectively attain the said age of twenty one years

I hereby give and bequeath unto the said Owen Swan the sum of One hundred pounds

I do hereby give and bequeath unto Elizabeth Howlett the daughter of Philip and Elizabeth Howlett of Haverill in the County of Essex (which said Elizabeth Howlett the mother deceased was one of the sisters of the said James Walford) the sum of ffive hundred pounds to be paid her by my said Trustees and Executors when she shall attain the age of twenty one years and I do direct my said Trustees and Executors to lay out and invest the said ffive hundred pounds as soon as they can in the purchase of Government Securities or parliamentary ffunds in their names and that the interest of the said Elizabeth Howlett and that my said Trustees and Executors do and shall transfer unto the said Elizabeth Howlett when she shall arrive at her said age of twenty one years all the Government Securities or Parliamentary ffunds which shall be so purchased with the said ffive hundred pounds and that they do at the same time and not before pay and apply all the accumulating interest and dividends thereof unto the said Elizabeth Howlett to and for her own use and benefit attains her said age of twenty one years then I direct the said ffive hundred pounds and the Government securities or Parliamentary ffunds which shall be purchased herewith and all the interest and dividends hereof shall sink into the Residuum of my Estate and effects and be had taken and considered as part thereof

I do hereby give and bequeath unto the aforesaid Philip Howlett the sum of One hundred pounds

I do hereby give and bequeath unto Elizabeth Walford the daughter of Robert Walford late of Billericay in the County of Essex Tanner (and brother of the Aforesaid James Walford) the sum of ffive hundred pounds to be paid to her by my said Trustees and Executors when she shall attain the age of twenty one years and I do direct my said Trustees and Executors to lay out and invest the said ffive hundred pounds as soon as they can in the purchase of Government Securities or Parliamentary ffunds in their names and that the interest and dividends thereof shall accumulate for the benefit of the said Elizabeth Walford and that my said Trustees and Executors do and shall transfer unto the said Elizabeth Walford when she shall arrive at her said age of twenty one years All the Government Securities or Parliamentary ffunds which shall be so purchased with the said ffive hundred pounds and that they do at the sametime and not before pay and apply all the accumulating Interest and dividends thereof unto the said Elizabeth Walford to and for her own use and benefit And And in case the said Elizabeth Walford shall dye before she attains her said age of twenty one years Then I direct that the said ffive hundred pounds and the Government Securities or Parliamentary ffunds which shall be purchased Therewith and all the Interest and dividends thereof shall sink into the Residuum of my Estate and Effects and be and

bequeath unto Elizabeth Piper the mother of Thomas and Elizabeth Walford late of Wheatley in the County of Essex the sum of twenty pounds and

unto Mary Tweed (the widow of John Tweed late of Stoke by Clare in the County of Suffolk deceased) the sum of One hundred pounds

I do hereby give and bequeath unto Ann Tweed one of the sisters of the said John Tweed deceased the sum of One Thousand pounds and I also give and bequeath unto the said Ann Tweed the further sum of ffive hundred pounds in Trust to distribute the same unto and amongst the children of her late sister Constance Bigg deceased at such times and in such shares and proportions as she shall think proper

I do hereby give and bequeath unto William Lyon of Red Lyon Street Holborn Surgeon the sum of One hundred pounds

I do hereby give and bequeath unto Jane the wife of the said William Lyon the sum of One hundred pounds to be paid to her by my said Trustees and Executors to and for her own sole and separate use and benefit And I do declare that her Receipt alone notwithstanding her Coverture shall be a sufficient discharge to my said Trustees and Executors for the same

I do hereby give and bequeath unto George Whatley of Southampton Row Bloomsbury Esq.re the sum of One Thousand pounds but in case he shall not be living at the time of my decease Then I give the said One Thousand pounds to Catharine the wife of the said George Whatley for her own use and benefit

I do hereby also give and bequeath unto the said Catherine the wife of the said George Whatley whether she shall be sole or married at the time of my decease the sum of ffive hundred pounds to be paid to her for her own sole and separate use and benefit and I do declare that her Receipt alone notwithstanding her coverture shall be a sufficient discharge to my said Trustees and Executors for the same

I do hereby give and bequeath unto the before named William Cooper of Winchester Street London the sum of Two Thousand pounds And unto the beforenamed John Ffree of Devonshire Square the Sum of One Thousand pounds

I do hereby give and bequeath unto Nathaniel Ffree Brother of the said John Ffree the sum of One Thousand pounds

I do hereby give and bequeath unto Nathaniel Newbury of Taplow in the County of Bucks the sum of One Hundred pounds

I do hereby give and bequeath unto Charles and Dorothy Wade of New North Street Red Lyon Square or to the survivor of them the sum of Two Thousand Pounds I do also give and bequeath unto the said Dorothy the wife of the said Charles Wade whether she shall be sole or or married at the time of my decease the sum of ffive hundred pounds to be paid to her for her own sole and separate use and benefit and I do declare that her receipt alone notwithstanding her coverture shall be a sufficient discharge to my said Trustees and Executors for the same

I do hereby give and bequeath unto Captain Robert Burdett of Hurley in the County of Bucks the sum of one thousand pounds

I do hereby give and bequeath unto Samuel Smoothey of Baythorne Hall in the County of Essex the sum of ffive hundred pounds as a recompense for the trouble and care which he has taken in my affairs

I hereby give and bequeath unto William Devon of New Court in the Temple London Gentleman the Sum of One hundred pounds And it is my will and desire And

I do hereby order and direct That the monies which shall arise by the sale of all my said ffreehold and copyhold Estates (except the said Estate called Tylers) in case the same Estates shall be sold and disposed of within twelve months next after my decease which I most earnestly intreat my said Trustees to do if they possibly can or the monies to arise by such parts thereof as shall be sold within that time shall be first applied in and towards payment and satisfaction of the several pecuniary legacies or sum and sums of money herein before by me given and bequeathed so far as the same will go and extend before any part of my monies in the public stocks or ffunds or on Government or other securities or any part of my personal estate is applied for that purpose But in case my said Estates nor any part thereof shall be sold within twelve months next after my decease Then I direct that my monies in the public stocks or ffunds or on Government or other securities and other my personal estate and effects shall be applied in payment and discharge of the said legacies

I do hereby desire order and direct that my said Executors do within three months next after my decease transfer into their names or into the name or names of such other person or persons as they shall think proper the sum of Ten thousand two hundred pounds part of my Bank annuities reduced to three per cent (now standing in my name in the books of the Governor and Company of the Bank of England) upon Trust for the following uses Intents and purposes that is to say upon trust that my said Executors do and shall from time to time pay and apply the whole of the interest or dividends which shall arise upon or from three thousand four hundred pounds (part of the said ten thousand two hundred pounds) as and when such Interest or dividends shall become due and payable unto the beforehand Mary Tweed the widow of the before named John Tweed deceased for and during the term of her natural life which interest or dividends

I do hereby give and bequeath unto here (over and above the legacy or sum of One hundred pounds hereinbefore bequeathed to her) and do direct that the same shall from time to time be paid to her to and for her own sole and separate use and benefit independant and free from the debts power control or intermeddling of any husband which she may happen to have and I do declare that her Receipt and Receipts alone whether she be sole or married shall be sufficient discharge to my said Executors for the same

And upon this further Trust that my said Executor do and shall from time to time pay and apply the whole of the interest or dividends which shall arise upon or from three thousand four hundred pounds (other part of the said Ten Thousand two hundred pounds) as and when such Interest or dividends shall become due or payable unto the before named Jane Lyon the wife of the before named William Lyon for and during the term of her natural life which interest or dividends I do hereby give and bequeath unto her (over and above the legacy or sum of one hundred pounds hereinbefore bequeathed to her) and do direct that the same shall from time to time be paid to her to and for her own sole and separate use and benefit independent and free from the debts power control or intermeddling of her or any future husband which she may happen to have and I do declare that her Receipt and Receipts alone notwithstanding her coverture shall be sufficient discharges to my said Executors for the same

And upon this further Trust that my said Executors do and shall from time to time pay and apply the whole of the interest or dividends which shall arise upon or from Three thousand four hundred pounds Residue of the said Ten Thousand two hundred pounds as and when such Interest or dividends shall become due or payable unto my servant Elizabeth Barnes (provided she shall be living with me at the time of my decease but not otherwise) for and during the term of her natural life and to and for her own sole and separate use and benefit independant and free from the debts power control or intermeddling of any husband she may happen to have and I do declare that her Receipt and Receipts alone whether she be sole or married shall be sufficient discharges to my said Executors for the same

And I do hereby declare that the first payment of the said interest or dividends of the said Ten thousand two hundred pounds shall begin and commence upon the first dividend day which shall happen next after the said ten thousand two hundred pounds shall be so transferred into the names of my said Executors as aforesaid and my mind and will further is and

I do hereby order and direct that when and as the said Mary Tweed Jane Lyon and Elizabeth Barnes shall respectively happen to dye then so much and such parts of the principal or capitol of the said Ten thousand two hundred pounds from which they or either of them are intitled to the interest or dividends thereof under and by virtue of this my will in manner aforesaid shall from time to time immediately upon such deaths happening sink into the Residuum of my Estate and Effects and that when the said Mary Mary Tweed Jane Lyon and Elizabeth Barns shall be all dead the Remainder of the said Ten Thousand two hundred pounds shall then also sink into such Residuum and be had taken and considered as part thereof and in case the said Elizabeth Barnes shall not be living with me at the time of my decease so as to become intitled to the Interest and dividends of the three Thousand four hundred pounds Bank Annuities hereinbefore directed to be paid to her for her Life Then I direct that immediately upon my decease the said three Thousand four hundred pounds shall sink into the Residuum of my Estate and Effects and be had taken and considered as part thereof and my Mind and Will further is that in case my said ffreehold and copyhold Estates hereinbefore directed to be sold or any part thereof shall not be sold and disposed of within twelve months next after my decease so that the Monies to arise therefrom cannot be applied in payment and satisfaction of the several pecuniary Legacies hereinbefore by me given and bequeathed so far as such Monies will go or extend and if my said Estates or such parts thereof as shall remain unsold at the Expiration of the said twelve months next after my decease shall be sold and disposed of before the several pecuniary Legacies hereinafter by me given and bequeathed (except the several Charitable Legacies hereinafter mentioned) become payable Then

I do order and direct that the x x x monies which shall so arise by the sale of my said Estates shall be first applied in and towards payment and satisfaction of the said several pecuniary Legacies hereinafter given and bequeathed (except the said several Charitable Legacies) But in case my said Estates shall not be sold and disposed of before the said several pecuniary Legacies become payable Then

I direct that the same Legacies shall be paid and satisfied out of my monies in the public stocks or ffunds and on Government or other Securities and other my personal Estate and Effects at the respective times such Legacies shall x x x x x x x x x x x x x x x x x x x x x x x x x x x x x x x x x x x x x x x x x x x x x x x x x x x x x x x x x x x x x x x x x x x x x x x x x x x x x x x x x x x x x x x x x x x become payable It being my Intention and desire that the payment of none of such Legacies shall be retarded delayed or postponed after the respective times the same shall become payable by reason or on account of my said ffreehold and copyhold Estates or any parts thereof not being sold and disposed of

I do hereby give and bequeath unto Thomas Walford (now a Minor) the son of Thomas and Elizabeth Walford late of Wheatly in the County of Essex the sum of ten Thousand pounds to be placed out at Interest on Government Securities or parliamentary ffunds by and in the Names of my said Executors within twelve months next after my decease and I do direct that the Interest and dividends thereof shall accumulate for the benefit of the said Thomas Walford and that my said Executors do and shall transfer and pay unto the said Thomas Walford when he shall arrive at the age of twenty one years One equal Moiety or half part of all such Government Securitys or parliamentary ffunds which shall be so purchased with the said ten Thousand pounds and that they do at the same time and not before pay and apply one equal Moiety or half part of all the said Interest or dividends which shall then have accumulated or be due thereon unto the said Thomas Walford to and for his own use and benefit and I do further direct my said Executors when and as soon as the said Thomas Walford shall attain the age of twenty five years and not before to transfer and pay to him the other Moiety or half part of all such Government Securities or parliamentary funds which shall be so purchased with the said ten thousand pounds and that they do at the same time and not before pay and apply all the Interest and dividends which shall then have accumulated or be due on the said last mentioned Moiety unto the said Thomas Walford to and for his own use and benefit

But in case the said Thomas Walford shall dye before he attains the said age of twenty one years Then I direct that the said then Thousand pounds and all the Government securitys or parliamentary funds which shall ^here be purchased therewith and all the interest and dividends which shall^ then have accumulated and be due thereon shall sink into the Residuum of my ^said^ Estate and Effects and be had taken and considered as part thereof and in case the said Thomas Walford shall happen to dye after he attains the said age of twenty one years and before he attains the age of twenty five years Then I direct that one full Moiety or equal half part of the said ten Thousand pounds and of all the Government Securities or parliamentary ffunds which shall be purchased therewith and of all the Interest and dividends which shall then have accumulated and be due thereon (which said Moiety the said Thomas Walford will become intitled unto upon his attaining the age of twenty five years and not before) shall sink into the Residuum of my said Estate and Effects and be had taken and considered as part thereof

I hereby give and bequeath unto Elizabeth the wife of Allen Taylor of Saffron Walden in the county of Essex Malster (Sister to the said Thomas Walford the son) The sum of One Hundred pounds to be paid to her to and for her own use and benefit and I do direct that her Receipt alone notwithstanding her Coverture shall be a sufficient discharge to my said Executors for the same

I give and bequeath unto John Tweed (oldest son of the before named John Tweed late of Stoke by Clare in the County of Essex deceased and next kin to my late uncle [above "Essex", which is underlined, is written "Suffolk"] John Pykes real Estate which I now Enjoy) the sum of three thousand pounds to be placed out at Interest on Government Securities or parliamentary funds by and in the Names of my said Executors within twelve months next after my decease and I do direct that the Interest and dividends thereof shall accumulate for the benefit of the said John Tweed and that my said Executors do and shall transfer and pay unto the said John Tweed when he shall arrive at his age of twenty one years all such Government Securities or parliamentary ffunds which shall be so purchased with the said three thousand pounds together with all the Interest or dividends which shall then have accumulated or be due thereon But in case the said John Tweed shall happen to dye before he attains the said age of twenty one years Then I direct that the said three Thousand pounds and all the Government Securitys or parliamentary ffunds which shall then be purchased therewith and all the Interest and dividends which shall then have accumulated or be due thereon shall sink into the Residuum of my said Estate and Effects and be had taken and considered as part thereof

I give and bequeath unto Thomas Tweed another of the sons of the said John Tweed deceased the sum of ffive Thousand pounds and unto

Joseph Tweed the youngest son of the said John Tweed deceased the sum of ffive thousand pounds and unto

Elizabeth Tweed the daughter of the said John Tweed deceased the sum of ffive thousand pounds and
I do direct my said Executors within twelve months next after my decease to lay out and invest the said three last mentioned Legacies making together ffifteen thousand pounds in the purchase of Government Securities or parliamentary ffunds in their own Names and that they pay and apply the Interest and dividends thereof from time to time to and for the Maintenance and Education of the said Thomas Joseph and Elizabeth Tweed until they shall respectively attain the age of twenty one years and that when and so soon as they the said Thomas Joseph and Elizabeth Tweed shall respectively attain the age of twenty one years Then I direct my said Executors to transfer and pay to each of them respectively as and when they shall so attain such age One full third part or share of one full and equal Moiety or half part of all such Government Securities or parliamentary ffunds which shall be so purchased with the said ffifteen Thousand pounds and also one full third part or share of One full and equal Moiety or half part of all such Interest or dividends which shall have accrued due thereon and not then been applied in the Maintenance and Education of the said Thomas Joseph and Elizabeth Tweed ^and that when and so soon as they the said Thomas Joseph and Elizabeth Tweed^ shall respectively attain the age of twenty five years then I direct my said Executors to transfer and pay to each of them respectively as and when they shall so attain such age of twenty five years One full third part or share of the other full and equal Moiety or half part of all such Government Securities or parliamentary ffunds which shall be so purchased with the said ffifteen Thousand pounds and also one full third part or share of all such Interest or dividends which shall have accumulated or accrued due or be then payable thereon and and not been applied for the purposes aforesaid and in case any or either of them the said Thomas Joseph and Elizabeth Tweed shall happen to die under the said age of twenty one years Then I direct that the part or share x or parts or shares of the said Government Securities or parliamentary ffunds and of the Interest or dividends aforesaid which he she or they so dying would have become intitled to upon attaining the said age of twenty one years shall go and be transferred and paid to and amongst the Survivors or Survivor of them as and when such Survivor or Survivors shall attain such age of twenty one years and in case any or either of them the said Thomas Joseph and Elizabeth Tweed shall happen to dye after he she or they shall attain the age of twenty one years and before he she or they so dying shall attain the age of twenty five years Then I direct that the part or share or parts or shares of the said Government Securities or parliamentary ffunds and of the Interest or dividends thereof which he she or they so living to attain the age of twenty one years and dying before attaining the said age of twenty five years would have become intitled to upon attaining the said age of twenty five years shall go and be transferred and paid to and amongst the Survivors or Survivor of them the said Thomas Joseph and Elizabeth Tweed as and when such Survivors or Survivor shall attain such age of twenty five years But in case the said Thomas Joseph and Elizabeth Tweed shall all dye before they or either of them shall attain the said age of twenty five years Then I do order and direct that the said several sums of ffive Thousand pounds ffive Thousand pounds and five Thousand pounds making together ffifteen thousand pounds and all the Government Securitys or parliamentary funds which shall be purchased therewith and all the Interest and dividends thereof which shall be unapplied for the purposes aforesaid shall sink into the Residuum of my said Estate and Effects and be had taken and considered as part thereof

I do hereby also give and bequeath unto the said John Tweed the son if he Survives me but if he dye in my lifetime Then I give and bequeath unto such other person or persons who shall be first intitled to take possession immediately upon my decease of my late uncle John Pykes real Estate and which I now enjoy for ^my^ Life All the furniture pictures Household Goods Household Linnen Plate China Ware Stores and Liquors of what nature or kind soever which I may have at or in the dwelling House called Baythorne House near Baythorne End in Essex belonging to me at the time of my decease And also all my Printed Books in Town and Country And it is my will and desire and I do hereby order and direct that no part of the said furniture pictures Household Goods Household Linnen Plate China Ware or Books be sold or otherwise disposed of But that the same and every part thereof shall remain and and continue in the said House called Baythorne House so long as the same shall be good and useful to and for the Advantage and benefit of the succeeding heirs to the said Estate And I do hereby direct that an Inventory of Schedule thereof be made within three Months next after my decease and kept and preserved by my said Executors

I give and bequeath unto Elizabeth the wife of Isaac Piper of Essex Farm in the parish of Redgewell in the County of Essex (one of the daughters of Elizabeth Willows deceased) the sum of Three hundred pounds to be paid to her for her own use and benefit and I do declare that her Receipt alone whether she shall be sole or married shall be a sufficient discharge to my said Executors for the same

I give and bequeath unto Margaret Willows and to Constantia Willows two other of the daughters of the said Elizabeth Willows deceased and sisters of the said Elizabeth Piper the sum of Six Hundred pounds to be equally divided between them share and share alike at their respective ages of twenty one years with benefit of Survivorship in case either of them shall dye before they attain that age But in case they shall both dye under that age Then I direct that the said Six Hundred pounds shall sink into the Residuum of my said Estate and Effects and be had taken and considered as part thereof

I do hereby give and bequeath unto the before named Elizabeth Barnes (provided she shall be living with me at the time of my decease but not otherwise) over and besides the Interest or dividends of three thousand and four hundred pounds Bank annuities hereinbefore bequeathed to her for her Life the sum of three hundred pounds and all my Linnen in my House at Baythorne (except the Household Linned there) and all my Household ffurniture Plate Gold Rings Gold and Silver Watches Linnen China Ware and Stock of Liquors of all sorts in my dwelling House in Lambs Conduit Street near Red Lyon Square provided that no part thereof shall be exposed to public sale in my said dwelling House and I do hereby give full Liberty for the said Elizabeth Barnes and do desire and direct my said Executors to permit her to live in my said dwelling House in Lambs Conduit Street three Months next after my decease without paying any Rent or other Consideration for the same

I give and bequeath unto all and every the servants who shall be living with me at the time of my death the sum of fifty pounds each over and above the wages which may then be due to them respectively and

I do direct that the Coachman who shall be employed to drive my carriage and be in that Service at the time of my decease shall be included in this bequest and intitled to the said Legacy of fifty pounds and that the said Elizabeth Barnes shall also be included in this bequest and be intitled to the said Legacy of fifty pounds over and above what I have hereinbefore given and bequeathed to her And

I do direct my said Executors to pay the said Legacies to my said Servants within three Months next after my decease

I give to Joseph Wilson my Coachman if shall be employed to drive my Carriage and be in that Capacity at the time of my decease But if he shall not Then I give unto such other person who shall be my Coachman at the time of my death and shall have been employed in that Service three Months next before my death my Chariot and Harness or such other Carriage and Carriages as I may have at my decease with the Harness and all other things appertaining thereto for his own use and benefit

I do desire and direct my Executors to give and divide all my wearing apparel (Linnen excepted) unto and amongst my Servants who shall be living with me at my decease in such parts shares and proportions as my said Executors shall in their discretion think fit unless I shall otherwise direct by any writing under my hand hereafter to be made

I do hereby give and bequeath unto each of my said Executors hereafter named (over and above what I have hereinbefore given and bequeathed to them respectively) the sum of Five Hundred Pounds as a Recompence and Satisfaction for the trouble which they may have in the Execution of this my will

I do hereby give and bequeath unto the poor of the parish of Layston aforesaid the sum of ffive pounds to be distributed amongst them in Bread the day after my ffuneral by the Church Wardens and Overseers of the Poor of the said Parish

I also give the sum of One Hundred Pounds to be distributed by the Minister or Vicar and the Churchwardends and Overseers of the Poor for the time being of the said Parish of Layston and by the Master of the ffree School of Buntingford aforesaid in such manner in such proportions and at such times as they or the major part part of them shall think fit to and amongst the most indigent Families in the said Parish of Layston and in the Parishes of Great and Little Hormead within twelve Months next after the said One Hundred Pounds shall be received by them of my said Executors and

I do direct that the whole or somuch of the said Sum of One Hundred Pounds as shall remain undistributed at the End of the said twelve Months shall be repaid to my Executors and sink into the Residuum of my Estate and that they give an account to and satisfy my said Executors in what manner they shall have applied the said Legacy of One Hundred pounds or any part thereof

I also give and bequeath unto the before named Samuel Smoothey of Baythorne Hall and to the Churchwardens and Overseers of the poor for the time being of the Parish of Birdbrook in the County of Essex the Sum of One Hundred pounds to be by them distributed amongst the most poor and indigent ffamilies of the said parishes of Birdbrook and parishes adjacent in such manner in such proportions and at such times as the said Samuel Smoothey and the said Churchwardens and Overseers Shall shall think best to answer the Intention of this my will

I do also give and bequeath unto the ffeofees or Trustees of the Charity School of and belonging to the parish of Saint George the Martyr aforesaid the sum of One Hundred Pounds to be paid to them by my Executors for the use and benefit of the said Charity School

I also give and bequeath unto the ffeofees or Trustees of the Charity School of and belonging to the Parish of Saint James Clerkenwell in the County of Middlesex the sum of One Hundred Pounds to be paid to them by my said Executors for the use and benefit of the said last mentioned Charity School

I also give and bequeath unto the Governors Guardians and Trustees of the Hospital for the Maintenance and Education of exposed and deserted young Children commonly called the ffoundling Hospital the Sum of One Thousand Pounds to be paid them by my Executors for the use and benefit of the said Hospital

I also give and bequeath the sum of One Thousand Pounds to the Treasurer or Treasurers for the time being of the Hospitals called by the Name of the Hospitals for the Small Pox and Inoculation to be applied towards carrying on the Charitable designs of the said Hospitals

I also give and bequeath unto the Treasurer or Treasurer for the time being of a Society who now call themselves the Governors of the Middlesex Hospital for the Reception of sick and lame Patients and lying in married women the Sum of One thousand Pounds to be paid them by my Executors for the use and benefit of the said Hospital and to be applied for and towards carrying on the Charitable designs of the said Society

I also give and bequeath unto the Governors of the London Hospital the Sum of One Thousand Pounds to be applied towards carrying on the charitable designs of the said Corporation

I also give and bequeath unto the Governors Guardians and Trustees of Christs Hospital in London the Sum of One Thousand Pounds to be paid to them by my Executors for the use and benefit of the said Hospital

I also give and bequeath unto the Governors Guardians and Trustees of Saint Bartholomew's Hospital in London the sum of One thousand Pounds to be paid to them by my Executors for the use and benefit of the said Hospital

I also give and bequeath unto the Governors Guardians and Trustees of St Thomas's Hospital in Southwark the Sum of One thousand Pounds to be paid them by my said Executors for the use and benefit of the said Hospital

I also give and bequeath to the Governors Guardians and Trustees of Bethlehem Hospital situate in Moorfields London the Sum of One Thousand Pounds to be paid them by my Executors for the use and benefit of the said Hospital

I also give and bequeath unto the Governors Guardians and Trustees of the British lying in Hospital for married women situate in Brownlow Street Long Acre London the Sum of One thousand Pounds to be paid them by my Exectutors which I desire may be applied towards carrying on the designs of the said Society

I also give and bequeath unto the Treasurer or Treasurers of a Society who now call themselves the Governors of the General Lying-in Hospital the Corner of Quebeck Street Oxford Road the Sum of One thousand Pounds to be paid them by my Executors and applied towards carrying on the charitable designs of the said Society

I also give and bequeath unto the Treasurer or Treasurers for the time being of a Society who now call themselves the Governors of Saint George's Hospital near Hyde Park Corner the Sum of One thousand Pounds to be paid them by my Executors and applied towards carrying on the charitable designs of the said Society

I also give and bequeath unto the Treasurer or Treasurers for the time being of a Society who now call themselves the Trustees of the Westminster Hospital or public Infirmary in James Street Westminster the sum of One thousand pounds to be paid them by my Executors and applied towards carrying on the Charitable designs of the said Society

I also give and bequeath unto the Governors Guardians and Trustees of the York Hospital near Hyde Park Corner the sum of One Thousand Pounds to be paid them by my Executors for the use and benefit of the said Hospital

I also give and bequeath unto the Governors Guardians and Trustees of the Society for propogating Protestant Schools in Ireland the Sum of One Thousand Pounds to be paid them by my Executors for the use and benefit and to carry on the pious designs of the said Society

I also give and bequeath unto the Governors Guardians and Trustees of Morden College situate on Blackheath in the County of Kent the Sum of One thousand Pounds to be paid them by my Executors and applied in such manner as the Trustees of the said College shall think most advantageous to the said Charity

I also give and bequeath to the Governors Guardians and Trustees of the Asylum or House of Refuge for Orphans and other deserted young Girls of the Poor situate near Westminster Bridge in the County of Surry the sum of One thousand pounds to be paid them by my said Executors for the use and benefit of the said Charity

I also give and bequeath unto the Governors Guardians and Trustees of the Magdalen House for the Reception of Penitent Prostitutes the sum of One Thousand Pounds to be paid them by my said Executors for the use and benefit of the said Charity

I also give and bequeath unto the Society for Propagating Christian Knowledge the Sum of One Thousand Pounds to be paid to them by my Executors to be applied for and towards carrying on the pious and Laudable designs of the said Society

I also give and bequeath unto the Society for propagating the Gospel in fforeign Parts the Sum of One thousand pounds to be paid them by my Executors and to be applied for and towards carrying on the pious and laudable designs of the said Charity And

I do hereby will and direct my said Executors hereinafter named to raise all and every the said Charitable Legacies hereinbefore by me given and bequeathed out of my Monies in the public stocks or ffunds or on Government or other Securities or out of such other parts of my personal Estate as they shall think proper and that they pay all and every the said several Charitable Legacies within twelve Months next after my decease And

I do direct that no part of the Monies to arise by the sale of my ffreehold and copyhold Estates hereinbefore directed to be sold shall be applied for or towards the payment of the said Charitable Legacies or any of them And all the rest residue and Remainder of my Monies in the public stocks or ffunds and on Government or other Securites whatsoever and of all other my Estates and Effects of what nature or kindsoever which I shall dye possessed of interested in or intitled unto x x x x x x x and all and singular the Bank Annuities and Government Securities or parliamentary ffunds and all other sum and sums of Money whatsoever hereinbefore by me ordered willed disposed or directed to sink into the Residuum of my Estate and Effects and to be had taken and considered as part thereof when the same shall so sink into and become a part of such Residuum (after payment of my just debts ffuneral Expenses and the Charges of proving this my wil)

I do order and direct my said trustees and Executors divide into four equal part and I do hereby give and bequeath one full equal fourth part thereof to the Governors Guardians and Trustees of the before mentioned Hospital for the Maintenance and Education of exposed and deserted young children commonly called the ffoundling Hospital to be paid to them by my said Executors for the use and benefit of the said Hospital One other full equal fourth part thereof

I hereby give and bequeath unto the Treasurer or Treasurers for the time being of the before mentioned Hospitals called by the Name of the ^Hospitals for the^ Small Pox and Inoculation to be paid to them by my said Executors and to be applied towards carrying on the Charitable designs of the said Hospitals One other full equal fourth part thereof

I do hereby give and bequeath unto the Treasurer or Treasurers for the time being of the before mentioned Society who now call themselves the Governors of the Middlesex Hospital for the reception of sick and Lame Patients and Lying in married women to be paid them by my Executors for the use and benefit of the said Hospital and to be applied for and towards carrying on the Charitable designs of the said Society And the remaining full equal fourth part thereof

I do hereby give and bequeath unto the Treasurers of St George's Hospital near Hyde Park Corner to be paid them by my Executors and to be applied towards carrying on the charitable designs of the said Hospital And it is my will and desire And

I do hereby Order and direct my said Executors to make such division of the said Residue of my said Estate and Effects and to pay and apply the same in the proportion aforesaid from time to time as the same or any part thereof shall come to their Hands or by any of the means aforesaid sink into or become part of such Residuum of my said Estate and Effects and it is my desire that none of the Governors Guardians or Trustees or Treasurers of any of the before mentioned Hospitals Societies or Houses of Charity shall have any power to examine into my Affairs but shall take receive the said Residuum of my said Estates at such times as my said Executors shall be able to pay it to them and it is my Mind and Will that in case any of the Legatee or Legatees hereinbefore named or any of the Governors Guardians Trustees or Treasurers aforesaid or other person or persons Society or Societys intitled to any Interest Benefit or Advantage whatsoever under or by Virtue of this my will shall refuse to acquiesce consent or agree to the several Gifts and bequests hereinbefore mentioned or to any other matter or thing whatsoever by me herein directed or shall refuse to give and execute proper discharge or discharges Release or Releases to my said Executors or to join with them in any Act or Acts which shall be thought necessary to be done by them or either of them for the better Execution of this my will or any clause article matter or thing therein contained or who shall contest the whole or any part of this my will Then such Legatee or Legatees Governors Guardians Trustees or Treasurers person or persons and Society or Societys shall not be intitled to or have take or receive any interest benefit or advantage whatsoever under or by Virtue of this my will and every Legacy Annuity Gift or bequest hereinbefore given and bequeathed to him her or them is hereby declared to be null and void to all Intents and purposes as fully and effectually as if such person or persons had actually died in my lifetime or such Gift or bequest had never been made

And it is my further will and desire and I do hereby order and direct that in case my said Estates and Effects and Monies in the public stocks or ffunds and on Government or other Securitys shall not by reason of the Low Price of such public ffunds or by any other cause or means whatsoever produce sufficient sums of Money after payment of my just debts ffuneral Expenses and the Charges of proving this my will to answer satisfy and pay all and singular the Legacies and Sum and Sums of Money hereinbefore by me given and bequeathed Then

I do direct my said Trustees and Executors in the first place to secure the said Sum of Ten Thousand two hundred pounds part of my Bank Annuities reduced to and for the several purposes hereinbefore mentioned concerning the same and in the next place to pay the several Legacies hereinbefore by me given to the several persons herein before named and then to divide the Residue of my said Monies in the public stocks or ffunds and on Government or other Securities Securities and the Residue of all other my Estate and Effects whatsoever unto and amongst the several Hospitals Charities Charitable Corporations and Societys aforesaid in proportion to the several Legacies or sums of Money hereinbefore bequeathed to them respectively It being my intent and meaning that in case of such deficiency the said several Charitable Legacies hereinbefore given and bequeathed and no other shall bear the loss occasioned by such deficiency and

I do hereby order and direct and give full power to my said Executors hereinafter named to keep and detain in their own hands and possession from time to time until this my will shall be fully executed such sum or sums of Money or Securities for Money as shall or may be sufficient for the payment of the several Legacies bequests donations and sum and sums of Money hereinbefore by me given and bequeathed or directed to be paid as aforesaid and also so much Money as shall be sufficient to defray and satisfy all Costs Charges and Expenses whatsoever which they or either of them shall or may sustain or be put into in or about the Execution of all or any part or parts of this my will and

I do hereby order and direct my said Executors to Burn or otherwise destroy all my Books of Accounts Letters and Papers whatsoever which shall come to their or either of their hands and which are not necessary to be kept by them for their justification and defence in the executing my will and

I do hereby nominate constitute and appoint the said William Cooper John Ffree and Charles Wade joint Executors of this my will and it is my desire that in case either of them shall dye before this my will is fully executed then and in such case

I do appoint the said Nathaniel Ffree hereinbefore named to succeed and be joint Executor with the Survivors or Survivor of them and in that case I hereby give him the said Nathaniel Ffree ffive Hundred pounds as a Recompence for his trouble therein over and above the Legacy of One Thousand pounds hereinbefore bequeathed to him and if any other Trustee shall dye before my will is fully executed then I do give full power and authority to the Survivor or Surviving Trustee or Trustees to appoint one or more person or persons to Act as Trustee or Trustees of this my will either jointly with him or them in their lifetime or after his or their decease with an adequate recompense for their trouble therein and Lastly

I do hereby revoke and make void all former and other wills by me at any time heretofore made and do declare this only to be my last will and Testament In Witness whereof I the said Thomas Pyke the Testator have to this will written on thirteen sheets of paper set my hand and seal to each sheet this sixteenth day of May in the year of our Lord One Thousand seven hundred and seventy two.

Whereas I the underwritten Thomas Pyke by my last will and Testament dated on or about the 16th day of May 1772 did desire my Executors therein named to distribute my wearing apparel amongst my servants at their discretion unless by any writing under my hand should be otherwise directed Now my will and desire is that Elizabeth Barnes may have all my velvet cloaths and every other sort of wearing apparel (Linnen only excepted already given to the said Elizabeth Barnes) I desire may be given to Samuel Jones if he continues with me at the time of my decease but not otherwise Moreover in my said will I bequeathed ffifty pounds to each of my servants who live with me at the time of my decease I do now make this additional Bequest that is To Samuel Jones I give ffifty pounds more the whole One Hundred pounds to be paid him when he attains the age of twenty one years To Elizabeth Cohen Housemaid I give fifty pounds more and to Elizabeth Wainright Cook I give Thirty pounds more and to Joseph Willson Coachman I give Thirty pounds more all these to be paid them over and above the ffifty pounds each already Bequeathed subject to the same condition of living with me at the time of my decease those who do not to receive no Benefit herefrom and this I declare to be a Codicil and deemed part of my said last will and Testament as witness my hand in London this sixth day of Novemember One Thousand seven hundred seventy two.

Thos Pyke Whereas I Thomas Pyke of Lambs Conduit Street in the parish of Saint George the Martyr did make my last will and Testament dated on or about the sixteenth day of may 1772 Wherein I appointed William Cooper of Winchester Street John Ffree of Devonshire Square and Charles Wade of New North Street Executors thereunto Now I do hereby direct appoint and constitute Nathaniel Ffree Brother and living with the said John Ffree to be joined with them and act as one of the Executors of my said last will and Testament and I do hereby give unto the said Nathaniel Ffree ffive Hundred Pounds over and above the legacy bequeathed him by my said Will as a recompence for the trouble he may have in my affairs and

I do hereby direct my said Executors William Cooper John and Nathaniel Ffree and Charles Wade within three three Months next after my decease to transfer into their Names or into the Names of the Survivor of them ten Thousand two hundred pounds part of my Bank Annuities reduced over and above the like sum by my said Will ordered to be transferred to my Executors ) for the following uses Trusts and purposes that is to say I give and bequeath unto Catherine Whatley ^wife of George Whatley^ now living in Southampton Row Bloomsbury besides what I have by my said will already bequeathed her the full Interest or dividends arising from Three Thousand four hundred pounds part of the said £10200 Bank Annuities reduced for her own sole and separate use during the term of her Life free from the power controul or any ways intermeddling of her present or any future Husband she may hereafter have to be paid to her by my Executors or any other they may appoint within ten days next after their receiving the same at the Bank and her Receipt alone notwithstanding her Coverture shall be sufficient discharge for the same

I also give and bequeath unto Charles and Dorothy Wade now living in New North Street or to the Survivor of them during his or her Life over and above the Bequest already made to them by my said will the full Interest or dividends arising from three Thousand four hundred pounds other part of the said £10200 Bank Annuities reduced to be paid as directed to Catherine Whatley

I also give and bequeath unto my servant Elizabeth Barnes if she lives with me at the time of my decease but not otherwise over and above the Legacies in my said Will bequeathed to her the full Interest or dividends arising from x x x three thousand four hundred pounds the remaining part of said Ten Thousand two hundred pounds Bank Annuities reduced to be paid to her by my Executors within ten days after the same becomes payable at the Bank for and during the term of her Life and when it shall so happen that Catherine Whatley shall dye or Charles and Dorothy Wade be both dead or Elizabeth Barnes shall die Then the part of the Bank Annuities reduced so transferred for payment of said Annuitants shall immediately sink into the Residuum of my Estate and be disposed of as such Residuum is by my said Will directed and this I do declare to be a Codicil and deemed and taken as part of my ^said^ last will and Testament In Witness whereof I hereunto set my hand this third day of April One Thousand seven hundred seventy three 1773.

Thos Pyke 3 Dec 1773 On which day appeared personally William Devon of the Middle Temple London Gentleman and by virtue of his Corporal Oath deposed that he knew and was well acquainted with Thomas Pyke late of the parish of Saint George the Martyr in the County of Middlesex Esquire deceased and hath several times seen him write and write and subscribe his Name whereby he became to know and be well acquainted with his manner and character of handwriting and Subscription and having now carefully viewed and perused the paper writings hereunto annexed purporting to be two Codicils to the last Will and Testament of the said deceased the first Codicil beginning thus "Whereas I the underwritten Thomas "Pyke by my last will and Testament" ending thus "As "witness my hand in London this sixth day of Novemember "One thousand seven hundred seventy two" and thus subscribed "Thos Pyke" and the second Codicil beginning thus "Whereas I Thomas Pyke of Lambs Conduit Street in the "parish of St George the Martyr" ending thus "In witness "whereof I hereunto set my hand this third day of April "One thousand seven hundred seventy three 1773" and thus subscribed "Thos Pyke" doth say that he verily and in his Conscience believes that the said two Codicils beginning ending and subscribed as aforesaid and the whole series and contents thereof to be of the proper handwriting of him the said Thomas Pyke Esquire deceased.

Wm Devon same day the said William Devon was sworn to the truth of this affidavit Before me John Loveday Surrogate presT Rogr Altham Notry Publ 3 Dec 1773 On which Day appeared personally Joseph Wilson of the parish of Saint George the Martyr in the County of Middlesex Servant and by Virtue of his Corporal Oath deposed that he knew and was well acquainted with Thomas Pyke (formerly Thomas Crouch) late of the parish of Saint George the Martyr in the County of Middlesex Esquire deceased and had several times seen him write and write and subscribe his Name whereby he became well acquainted with his manner and character of handwriting and Subscription and having now carefully viewed and perused the paper writings hereunto annexed purporting to be two Codicils to the last Will and Testament of the said deceased the first Codicil beginning thus "Whereas I the underwritten Thomas Pyke by my last Will & Testament" ending thus "As witness my Hand in London this sixth day of Novemember "One thousand seven hundred seventy two" and thus subscribed "Thos Pyke" and the second Codicil beginning thus "Whereas "I Thomas Pyke of Lambs Conduit Street in the parish of "St George the Martyr" ending thus "In witness whereof I "hereunto set my hand this third day of April One thousand seven hundred seventy three 1773" and thus subscribed "Thos Pyke" doth say that he verily and in his Conscience believes the said two Codicils beginning ending and subscribed as aforesaid and the whole series and contents thereof to be of the proper proper handwriting of him the said Thomas Pyke Esquire deceased Joseph Wilson same day the said Joseph Wilson was sworn to the truth of this affidavit Before me.

Geo Harris surrogate prest Robt Nathl Bogg Not. Pub. 3 Dec 1773 On which Day appeared personally Peter Allams of the parish of Saint Clement Danes in the County of Middlesex Gentleman and by Virtue of his Corporal Oath deposed that he wrote the Will and Testament of Thomas Pyke formerly named Thomas Crouch late of the parish of Saint George the Martyr in the County of Middlesex Esquire deceased hereunto annexed bearing date the sixteenth day of May One thousand seven hundred and seventy two that he copied the same from a Draught thereof and that thro' mistake in copying the same as aforesaid he wrote the word "thousand" on an Erasure in the twelfth Line from the top of the third Sheet of the said Will and he interlined the words "Sum of Five thousand pounds and unto Elizabeth Tweed the Daughter of the said John Tweed deceased the" between the fifth and sixth Lines from the top of the seventh Sheet of the said Will and he wrote the words "and bequeath unto the Treasurers of St Georges Hospital near Hyde Park Corner" upon an Erasure in the thirty eighth Line from the Top of the Eleventh Sheet and the word "Hospital" in the thirty ninth Line from the Top of the said eleventh Sheet of the said Will and he further saith that such Alterations were made before the said Testator executed the said Will and that he verily believes the same now is in the same plight and condition it was in at the time of such Execution.

Peter Allam. same day the said Peter Allam was sworn to the truth of this affidavit Before me Will Macham Surrogate Prest Rogr Altham Notry Publ

This Will was proved at London with two Codicils the fourth day of December in the year of our Lord One thousand seven hundred and seventy three before the Worshipful George Harris Doctor of Laws and Surrogate of the Right Worshipful ^Sir^ George Hay Knight Doctor of Laws Master Keeper or Commissary of the Prerogative Court of Canterbury lawfully constituted by the Oaths of John Ffree and Charles Wade Esquires two of the Executors named in the said Will and Nathaniel Ffree Esquire the Executor named in the second Codicil to whom Administration was granted of all and singular the Goods Chattels and Credits of the x x x deceased having been first sworn only to administer power reserved of making the like Grant to William Cooper Esquire the other Executor named in the said Will when he shall apply for the same.

This Will was proved at London with two Codicils the twenty fourth day of December in the year of our Lord One thousand seven hundred and seventy three before the Worshipful George Harris Doctor of Laws and Surrogate of the Right Worshipful Sir George Hay Knight Doctor of Laws Master Keeper or Commissary of the Prerogative Court of Canterbury lawfully constituted by the Oath of William Cooper Esquire the other Executor named in the said Will to whom Administration was granted of all and singular the Goods Chattels and Credits of the deceased having been first sworn duly to administer.
